Actually xaos I thought the exact same thing after reading the brain
siezing legal jargon in the member agreement, so I went to the helpdesk and
lo and behold there was a "plain english" version (ie: dummed down) of the
member agreement regarding the intellectual rights ownership of the images
you choose to download, and cafepress' "rights" to it.

In essence, when you agree to a membership, you do not sign away your
rights to the artwork, you simply are giving them the legal authority to
promote, manufacture, and sell merchandise with your images on it on your
behalf. That's it. They are not legally able to use your images in any
other way, for any other purpose, and once you cancel your membership with
cafepress they no longer hold any rights to the images or merchandise with
your images on them. It is a protective method on behalf of the vendors
and themselves, to ensure that if you use someone else's image (from
anywhere) and that person discovers that you are and decides to take legal
action, it all comes down on the plaigerist and not cafepress.com in an
intellectual property suit. Hence if someone uses YOUR images in the same
fashion, you can sue THEM. It keeps cafepress out of the hot spot of
frivolous lawsuits (and they clearly define what is considered abuse of
intellectual property), and protects the vendors from being violated.
When I read the member agreement in the crazy ass lawyer language I was
like "OOOOOOHHHH no you don't, assholes, fuck you". Then I decided to
email them on the issue on whether or not they would have any sort of
"ownership" to my artwork, when I saw the dummed down version that clearly
explains the agreement, which put my overworked brain at ease.
If you have further concerns, email them!
cafepress is fun. I've sold a few things off my stores so far, and the
basic shops are free, so as far as I'm concerned it's free advertising, a

Good! I can understand tho, I freaked out to. Legal jargon can make a pie
recipe seem danuting and perilous and evil.

it is good to see that through pressure they have negated the "new" TOS,
tho. I hadn't heard of it when it came out. If they DID proceed with such
a shitty policy of "stealin" artwork, I would have cancelled my membership
immediately!
I'm checking out those other sights as we speak, so perhaps they'll have

hmmm, still seems a bit off. I like to at least see a person who is buying
something of mine, but then, I am unexperienced when it comes to selling my
stuff, I've only sold a few pieces, and most were copies. And also, can you
just sell copies if you don't want to sell the origionals on the internet.? ____________________ When the world is over, will we wonder how it began? |

Bettie: Go on and make that vegan cheesecake and send me a piece. You wont have
to eat it all, hehe. Hey, I walk a lot so I wont have to worry about
getting a big butt (not any bigger than it is, anyway). *cheeky grin*
In all seriousness, vegan cheesecake sounds good *though isn't one
herself*...just damn expensive to make.

Okay, I just called myself a vegan cheesecake in the last post...what the
Hells, lmao. I meant not being a vegan myself...just love the vegan
cheesecake.
Goddamn, I shouldn't have had that ginseng pill and the yogurt green
tea...now I'm jumping off the walls...
