Shmeng of the Week: Rallying the troops |
Posted by
bettie_x on Monday, November 18, 2002 - 03:37 PM PST
Hey everyone.
Allow me a minute or an hour of your time...and maybe you can help a couple of friends in need. We don't ask much...just a small favor, porfavor...
Here is our story...think of it as a performance, if you will, on a stage of utter ridiculousness and tragic corporate garbage. On that note.
Let's introduce our colorful cast of characters!!
Michael: Our protagonist, youngest child, bat lover, fashion connoisseur, person at the ass end of a greased totem pole at this moment.
Angie: Middle child, works in management with Michael, likes buttrock and skulls, on our side.
Cindy: Oldest sister, works with angie and michael, cause of this whole mess, NOT on our side.
Let's begin on the 12th of October, 9AM. Michael's lung goes *PHLOOF* and collapses....lucky number three. He lands in the hospital with a rather gnarly tube in his chest, and unfriendly nurses. They perform a procedure to prevent his lung from going *PHLOOF* again, which hurts like a mofo and knocks him out of commission for THREE WEEKS.
*time swirly*
Last Friday...four days until he finally returns to work. We receive a call from Angie (oldest sister..management..our side) telling him to have his prescription receipts handy when he comes back to work. Why? You ask? Oh well let me tell you!!
Cindy (Oldest sister..phones..messmaker) was apprehended at work peddling narcotics. Come to find out she had been using Michael's sob story (hospital, stupid doctors, pain) to get prescription pills off other employees for her own use. While in recovery, they did not talk even once, on the phone or otherwise. I saw her a few times while dropping paperwork off at the workplace, gave her a brief update on him, and got out of there.
Now here's the kicker. After being caught, in essence, she "threw him under the bus". After changing her story THREE times under questioning, contradicting herself and tripping over her stories several times, she said that she was getting the drugs for MICHAEL because the doctors wouldn't give him meds for his pain! I would go into further detail the things she said to try to cover her ass, using Michael's good reputation to get her out of yet another mess, but you get the jist of it.....
anyway.
Michael arrives at work today, on time as always, and is handed a termination letter. It stated he was being terminated on the basis of violating the company's drug and alcohol policy. He demanded a drug test, and was refused. He immediately left the building and came home, and we went right to a hospital and paid $280 out of pocket for a drug screening, which turned up, of course, 100% NEGATIVE for ANYTHING.
What's my point? He was fired on nothing but HERESAY by a KNOWN DRUG ADDICT AND COMPULSIVE LIAR who only succeeded in dragging michael down with her! AND was not even given a chance to DEFEND himself or prove otherwise!
Here's what we are doing/have done so far:
Paid for a professional drug screening, which came up negative, retrieved the preliminary copy, waiting for the hard copy.
Written and emailed a grievance letter to management stating the facts of the situation, as well as citing his attendance/performance record (spotless) and how it compares to other staff members and is definitely NOT compliant with a drug user/seeker.
Compiled all of his medical records pertaining to his hospital stay, discharge, and checkups as well as his prescription receipts and packages and unused product for verification.
Called a lawyer that specializes in employment law (seems promising but still looking).
NOW *BIG NOISE* what I need from YOU...you wonderful troops you...
An anonymous co-worker/s of his have put up a website "FREE MICHAEL"
to let fellow employees, friends, and really REALLY bored internet browsers email the CEO and let them know what they THINK about an honest, hard working man being fired on untrue, unfounded, and baseless accusations by unreliable sources!
It would be much appreciated, you know.
And if you have any legal advice, don’t hesitate to post it. We'll take what we can get.
We don't want to sue for ridiculous and exorbitant amounts of money.
We just want him to be given back the job that he worked hard to get, that he EARNED, and that was stripped of him unfairly.
And if we can't have that...we're taking it as far as insanity will allow. There are others in his position too....you won't just be helping us, you'll be helping them too.
Please, if you choose to do us this little favor, refrain from crude and violent language, as that will get us absolutely nowhere and endanger his chances of getting his job back. Be honest, adult, and let them know just how WRONG this is.
Thanks for your time, guys..michael thanks you too!

Only thing I can really think of would be to get signed statements from each of the nurses in the ward he was in detailing that they hd not seen the woman in the ward, talkign to Michael, or given him anything.
If all else fails, sue.

I am not optimistic that electronic petitions (especially from a lot of people who have never actually physically met Michael and can only vouch for his character based upon second hand information) will be very persuasive and might even prove to be detrimental depending upon who can be trusted to say what. However, if things happened the way you have described them, any decent employment attorney should have no difficulty handing the management of this institution their collective asses all gift wrapped for the holidays. My only "legal" advice is to DOCUMENT EVERYTHING.
I wish you guys the best of luck, and hope that Michael and his lungs are doing better!

Well, I don't think that petitions will do anything either...someone put it up from work to "cheer him up". It's to make a point. As of right now there is no chance he's getting his job back. Washington is an "at will" state. They can fire you anytime they want. Plus, as we've delved deeper into this mess, it's gotten even more fucked up, more rediculous, and more hopeless.
I just find that it's very interesting how they can terminate someone without an investigation based on nothing but hearsay, yet you cannot redeem yourself based on that either. Hell, you can't redeem yourself even with cold hard PROOF.
Our main issue right now is his employment. He was fired for "violation of the drug and alcohol policy"...tho they have no proof. How the fuck do you explain that in an interview?! Plain and simple they have FUCKED US. FUCKED US HARD.
Another interesting tidbit in this, his name and information has almost certainly been turned into the auburn police department. (!!!!) Cops were at the facility after Darren (asshole that fired him) got off the phone to "OFFICIALLY" fire him (in essence, fire him TWICE). His information was turned into the fucking cops.
We talked to a lawyer today, and the stupid twat was lucky his consultation was free otherwise he'd have gotten a new place to shit from. He said we had no case (which wasn't a huge suprise, but an angering and disapointing confirmation of our worst fears) but his answers were ambiguous at best. He couldn't even tell us what to tell potential employers! Or what to do to assure his name is clear! "you just have to wait and see what happens". FUCK YOU!
We have another consultation on wednesday with a different lawyer, it'll cost us a precious $80...but we have to talk to at least one more person, if only to figure out how to clear his name. He deserves at least that.
This is so fucked...so very fucked.
We are also contemplating an out of state move.
To somewhere where we can be anonymous.
To somewhere his family isn't.
To somewhere we can start over.
Somewhere safe.
Somewhere quiet.
Anywhere but here and now.

The assness of this situation is so beyond me, I have to make up new words to express my disbelief. They didn't just fuck you guys, they fucked you up the ass with sand. Hot sand.
I hope that all the crab infested snatches you have been forced to deal with, related or not, find themselves in a dark alleyway with a 300 pound, corn-fed, good ol' boy who thinks they have right purdy rear ends.
I also hope Michael is feeling better and that this works out for you both.

Wow, I don't have any advice unless Michael knows some deeop and dirty secret about the company, other than that you have my hopes that you can get his job back. Good luck!

How about sueing for libel, or defamation of character?
I mean, that's what they are doing? They fired him for violating the drug policy of the company, ok, they are apparently alloud to do that, but since he never did anything, and they are still saying that he did, up to and including involving the police, then they are spreading untruths.
If the inquirer released an article saying that Michal Jackson was a dope fiend, he'd be all over them in no time. I suggest you do the same.

I agree with what Xaoswolf said about maybe pursuing a suit against the lady who was responsible for this whole thing getting set into motion.
It's just incredible the amount of ignorance and backstabbing that can go on in a workplace. I feel so bad for you guys to have had this sort of crap happen to you. It's completely wrong in every way.
The incredibly sad part is how the employer wasn't even interested in hearing what Michael had to say in his defense. I would think they should have thought about the source and maybe checked her out to see why she would be so consumed with blaming someone right away. They should have thought how odd it would be for someone to be asking for drugs from others for someone else anyway. It just sickens me how something like this could happen to you guys.

I wish your friend the best of luck with this and you have my support.
Aye, as M said, document everything. Gather up the evidence to prove Mr. Glew's innocence for with the proper documentation and such, this should be a easy case. One thing that will be a great resource is to make sure that his co-workers are willing to speak to his boss, the president of LiveBridge and any other needed contacts.
One question, (this may sound abit juvenile) was he in a union or is there a union representing the employees of the company which he worked for? If so, they should have already known about this.
Rest assured my e-mail will be sent to Mr. Hanlin soon enough.

Thanks for the support guys, we really appreciate it. And need it.
The problem with slander is that you have to PROVE that it was said, and that it's untrue. The problem with that is that it's all hearsay. Very hard to prove.
We're not even thinking there is a lawsuit possible, but my main objective tomorrow morning is to find out just how the fuck we clear his name. He has no police record, hell, not even more than one or two traffic tickets, no drug history, no criminal background, and a squeaky clean work history.
It's amazing and sickeningly true that rumors can ruin lives.
Another thing I was thinking of today...just how much Unions are like the mafia. You have to PAY for protection. Isn't that fucked? That unless you PAY for job security, you have none. That good sense, good word, and integrity mean absolutely nothing anymore. MONEY TALKS...and unless you pay, you pay in a harder way. A much harder way.
I just wanna know what the ever living fuck happened to due goddamned process.
Innocent until proven guilty my ass.

ON a side note, we have decided to consult that second attourney, and we're taking my friend the "not fuck me, FUCK YOU" redheaded scorpio (woman who recommended the attourney) with us for backup.
It should be interesting.'
I really think she's as pissed off about this as we are! She was yelling into the phone about it as loud as I was...and even said, quote "And if that DIPSHIT calls again tell him you guys ARE NOT SPEAKING TO HIM and say ' AND YOU CAN KISS MY BARE WHITE ASS, PRICK' "
I love her :D

"Dear, "Broken Wish." My name is Ron Britt. I am the Director of Employee
